These terms along with a completed registration form (Form) make up the terms on which you agree to participate in the 2016 McDonald’s AFL 9s Classic (Tournament) as described at afl.com.au/afl9sclassic (Agreement).
1. Application to Participate
(a) In order to participate in the Tournament you must:
(i) complete the online registration Form; and
(ii) agree to comply with the Code of Behaviour, (Application).
(a) The AFL will not:
(i) process any Application that is incomplete, incorrect, unclear or damaged; or
(ii) accept any changes to the Application, except for a change of contact details.
2. Rules, Regulations and Policies
By agreeing to these Terms of Participation your agree to be bound by:
(i) the rules, regulations, by-laws and policies of the Tournament (Rules);
(ii) the National Member Protection Policy (available at http://www.aflcommunity.com.au/index.php?id=211 ), as they are presently constituted and as amended or determined from time to time.
3. Cancellation, Refunds and Termination
(a) You must notify the AFL if you wish to cancel your Application.
(b) The AFL is not liable to you for any loss or damage you suffer as a result of the Tournament being cancelled, postponed or changed.
(c) Without limiting the Rules, the AFL may terminate your involvement in the Tournament on reasonable grounds at any time, including if your behaviour interferes with other participants’ safety or enjoyment of the Tournament.
(a) The personal information that the AFL collects on the Form is used for the purpose of processing your request for participation in the Tournament.
(c) The medical information that the AFL collects on the Form is used for the purpose of protecting your health and safety during the Tournament. By providing your medical information you acknowledge and agree that the AFL may use your medical information for the purpose of protecting your health and safety and in accordance with privacy laws.
(a) You consent to the AFL using your name and image and footage (Image) in any form or medium for any marketing or promotional activity in connection with the Tournament (Purpose), including use for the Purpose by AFL affiliates and AFL partners.
(b) You agree that your Image may be altered or modified in any manner.
(c) You agree to release the AFL, AFL affiliates and AFL partners from any claims or remuneration associated with any form of damage, foreseen or unforseen associated with the use of your Image.
(d) If you do not consent to your Image being used you acknowledge that you must contact the AFL in writing.
6. Limitation of Liability and Release
(a) You understand that there are inherent risks associated with participation in the Tournament, which may result in personal injury (even of a serious nature) to you and other participants and you fully accept and agree to bear those risks.
(b) You agree not to bring any claim or proceeding against the AFL (including any AFL employee, contractor or agent) or any AFL affiliate for any damage, loss or injury whatsoever that you may suffer from participation in the Tournament.
(c) To the extent permitted by law, you agree that the AFL accepts no liability in connection with this Agreement.
(d) You agree to accept responsibility for the safety of other participants and if an injury occurs as a result of your act, omission or negligence then you agree to fully assume responsibility for any harm done and you will not hold the AFL concurrently responsible.
(e) You agree not to participate in the Tournament while intoxicated or affected by drugs.
(f) You warrant that you have no medical condition limiting your ability to participate in the Tournament and you agree to indemnify the AFL and its affiliates for all loss suffered in connection with a breach of this warranty and any term under this clause 6.
(g) You understand that as a registered player participating in an AFL recreational football competition you are entitled to certain sports injury insurance benefits available at http://afl.jltsport.com.au/recreational.aspx. You accept that the level of cover provided to you as a participant is the level chosen by the Australian Football League and does not include ‘Gap’ insurance.
(a) The AFL may reject or choose not to accept your registration in its absolute discretion, including (without limitation) in circumstances where:
(i) the AFL determines in its discretion that you are not a fit and proper person to participate in the Tournament; or
(ii) there are insufficient teams or participants to conduct the Tournament.
(b) The AFL may change the Rules, dates, session times, duration and location of the Tournament at any time and without notice.
CODE OF BEHAVIOUR
By submitting an Application to participate in the Tournament you agree to adhere to the code of behaviour as follows, to:
(a) participate in accordance with the Rules;
(b) never argue with the AFL or persons participating in or conducting the Tournament;
(c) not engage in and conduct that brings, or is likely to bring, you, your team, the AFL or the Tournament into disrepute or censure;
(d) treat all participants as you would like to be treated. You agree not to sledge, abuse or take unfair advantage of another participant;
(e) participate for your own enjoyment and benefit and for the enjoyment and benefit of other participants;
(f) respect the rights, dignity and worth of all participants regardless of sex, gender, ability, cultural background or religion;
(g) not take part in any form of bullying including via the use of social media;
(h) not make any public statement about the Tournament, the AFL, or an AFL affiliate without the AFL’s prior approval; and
(i) accept responsibility for your actions.
Where the participant is under 18 years of age, by completing the Application, the parent or guardian of the participant:
(a) acknowledges that he or she has read and explained the contents of the Application to the participant;
(b) consents to the participant taking part in the Tournament subject to the terms of this Agreement; and
(c) declares that the statements made in the Form are true and correct.
